Welcome to Modo Casino. These Terms of Service ("Terms") constitute a legally binding agreement between you and Modo Casino Affiliate ("we," "us," or "our") governing your use of our website (us-modocasino.com) and our free-to-play social casino gaming services.

1. Eligibility and Participation

However, our services and sweepstakes are VOID AND STRICTLY PROHIBITED for individuals located in the states of Washington, Michigan, Idaho, and Nevada. If you reside in or are physically present in any of these restricted states, you may not open an account or play.
  • Identity: You must provide accurate, current, and complete information during the registration process and keep your account details updated.
  • Single Account: You are permitted to open only one (1) account per person, per household, per IP address, and per device. Duplicate accounts will be immediately closed, and any associated virtual currency will be voided.

2. The Virtual Currency System

Modo Casino operates as a social casino using a dual virtual currency system. It is important to understand the distinction between the two types of currencies:

A. Gold Coins (GC)

Gold Coins are a virtual social currency used solely for entertainment purposes to play games on the Site. Gold Coins hold no real-world monetary value and can never be redeemed for cash, real prizes, or any other item of value outside of the game. Gold Coins can be obtained for free through daily bonuses and promotions, or they can be purchased within the platform.

B. Sweepstakes Coins (SC)

Sweepstakes Coins are sweepstakes entry tokens. They cannot be purchased under any circumstances. Sweepstakes Coins are only provided as a free bonus when you purchase specific Gold Coin packages or through Alternative Methods of Entry (AMOE), such as daily logins or sending a request by mail. Sweepstakes Coins used to play games may result in winnings of additional Sweepstakes Coins, which, subject to our redemption rules, may be redeemed for real cash prizes or gift cards.

NO PURCHASE IS NECESSARY TO OBTAIN SWEEPSTAKES COINS OR TO ENTER ANY SWEEPSTAKES.

3. Purchases and Payments

You may choose to purchase packages of Gold Coins to enhance your social gameplay. By making a purchase, you agree to the following:

  • All purchases of Gold Coins are final and non-refundable.
  • You must use a payment method that is legally registered in your own name. Use of third-party payment methods is strictly prohibited and may result in account suspension.
  • We reserve the right to change the price of Gold Coin packages at any time without prior notice.
  • If a purchase is subjected to a chargeback, dispute, or is otherwise reversed, we reserve the right to suspend or terminate your account and void any associated virtual currency.

4. Prize Redemptions

If you accumulate a sufficient amount of eligible Sweepstakes Coins through gameplay, you may request to redeem them for prizes.

  • Minimum Thresholds: Redemptions are subject to minimum thresholds, which are clearly stated in the redemption section of your account dashboard. Typically, the minimum redemption for cash prizes is higher than that for gift cards.
  • Verification Required: Before any redemption can be processed, you must successfully complete our Know Your Customer (KYC) verification process. This involves submitting valid government-issued photo identification and proof of address.
  • Payment Method: Cash prize redemptions will only be processed to a bank account or financial instrument registered in the exact same name as your Modo Casino account.
  • Processing Times: We strive to process redemptions quickly; however, processing times may vary depending on the chosen method and the time required for security checks.

5. Prohibited Conduct

To maintain a fair and safe environment for all players, the following activities are strictly prohibited. Engaging in any of these may result in immediate account termination, forfeiture of all virtual currency, and potential legal action:

  • Fraud and Cheating: Using any automated software (bots), hacks, mods, or any other unauthorized third-party tools to manipulate the games or the platform.
  • Collusion: Cooperating with other players to gain an unfair advantage or manipulate game outcomes.
  • Exploitation: Exploiting any bugs, glitches, or vulnerabilities in the system.
  • Money Laundering: Attempting to use the platform to facilitate money laundering or any other illegal financial activity.
  • Multiple Accounts: Operating more than one account per individual or household.
  • Account Selling/Sharing: Selling, trading, or sharing your account details with any third party. Your account is for your personal use only.

6. Responsible Social Gameplay

We are committed to providing a fun and responsible social gaming experience. We offer various tools to help you manage your gameplay, including:

  • Purchase Limits: You can set daily, weekly, or monthly limits on the amount you can spend purchasing Gold Coins.
  • Time Limits: You can set limits on the amount of time you spend logged into the platform.
  • Time-Outs and Self-Exclusion: If you feel you need a break, you can request a temporary time-out or a long-term self-exclusion from the platform. During a self-exclusion period, you will not be able to access your account.

7. Intellectual Property

8. Limitation of Liability and Disclaimer of Warranties

IN NO EVENT SHALL MODO CASINO, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9. Governing Law and Dispute Resolution

These Terms and any disputes arising out of or related to them or your use of the Site shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles.

Binding Arbitration and Class Action Waiver: Any dispute, controversy, or claim arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, shall be resolved by binding arbitration administered by the American Arbitration Association (AAA), rather than in court. You agree that any arbitration will take place on an individual basis; class arbitrations and class actions are not permitted.

10. Modifications to the Terms

We reserve the right to modify or update these Terms at any time at our sole discretion. We will notify you of any material changes by posting the new Terms on the Site and updating the "Last Updated" date. Your continued use of the Site after such changes constitutes your acceptance of the revised Terms.
